Terms of Service

1. Acceptance of Terms

By creating an account, accessing, or using any part of the Sendburg platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you are agreeing on behalf of an organization, you represent that you have authority to bind that organization.

If you do not agree to these Terms, do not use the Service. These Terms constitute a binding legal agreement between you (or your organization) and Sendburg Technologies Pvt Ltd, a company incorporated in India.

2. Service Description

Sendburg is a B2B contact intelligence platform that provides:

• Access to a database of verified business contact information
• AI-generated company intelligence and account briefings
• Buying signal detection and intent data
• Technology stack intelligence
• CRM integrations and data export capabilities
• Chrome extension for on-page intelligence

The Service is intended exclusively for B2B sales, marketing, and revenue operations use cases by business professionals. The Service is not intended for and may not be used for consumer marketing, personal use, or any purpose unrelated to professional business development.

3. Account Registration

To use the Service you must register for an account. You agree to:

• Provide accurate, current, and complete registration information
• Maintain the security of your password and account credentials
• Promptly notify us of any unauthorized access or security breach
• Be responsible for all activity that occurs under your account
• Not share your account credentials with others outside your authorized team

You must be at least 18 years old to create an account. Accounts registered with false information may be suspended without notice.

4. Subscription & Billing

Sendburg offers the following plan tiers:

• Paid subscriptions renew automatically at the end of each billing period unless cancelled.
• You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No partial refunds are issued for unused portions of a billing period.
• Annual subscriptions that are cancelled within 14 days of the initial purchase date are eligible for a full refund.
• We reserve the right to change pricing with 30 days' written notice to existing subscribers.
• All prices are in USD. Indian customers may be billed in INR via Cashfree.

5. Credits & Usage

The Service operates on a credit system. One credit is consumed each time a verified contact record is revealed (email, phone, or full profile).

• Credits are allocated monthly and do not roll over to the next billing period unless otherwise stated.
• Credits used to reveal a contact that proves undeliverable are automatically refunded within 24 hours.
• Credits may not be transferred between accounts.
• Unused credits at the end of a billing period are forfeited.

6. Acceptable Use

You may use the Service only for lawful B2B business purposes. You agree not to:

• Use contact data for consumer marketing, spam, or unsolicited personal communications
• Resell, sublicense, or redistribute contact data to third parties without our written consent
• Use the data to harass, stalk, or harm any individual
• Attempt to scrape, extract, or mirror our database by automated means
• Use the platform in violation of any applicable law, including anti-spam laws (CAN-SPAM, CASL, GDPR)
• Use the Service to build a competing database product
• Share or publish contact data in any public forum
• Circumvent any rate limits, access controls, or security features of the Service

Violation of acceptable use policies may result in immediate account suspension or termination without refund, and may expose you to legal liability.

7. Data & Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

You acknowledge that:

• The B2B contact database contains professional contact information sourced from publicly available sources.
• You are responsible for ensuring your use of contact data complies with applicable laws in your jurisdiction, including GDPR, CAN-SPAM, and CASL.
• You must honor opt-out and do-not-contact requests from individuals in the database.
• You may not use contact data for purposes incompatible with those disclosed in our Privacy Policy.

8. Intellectual Property

Sendburg and its licensors own all rights, title, and interest in the Service, including the platform software, database, AI models, brand assets, and all related intellectual property. Nothing in these Terms grants you any rights to our intellectual property except the limited license to use the Service as described herein.

You retain ownership of your account data and any content you input into the Service. By using the Service, you grant Sendburg a limited license to process your data for the purpose of providing the Service.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted or error-free, that contact data will be 100% accurate or complete, or that the Service will meet your specific requirements. Contact data accuracy is subject to our 90-day verification cycle and credit refund guarantee for undeliverable results.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SENDBURG SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, WHETHER INCURRED DIRECTLY OR INDIRECTLY.

IN NO EVENT SHALL SENDBURG'S AGGREGATE LIABILITY TO YOU EXCEED THE GREATER OF (A) THE TOTAL FEES PAID BY YOU TO SENDBURG IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) USD $100.

11. Indemnification

You agree to indemnify, defend, and hold harmless Sendburg and its officers, directors, employees, and agents from any claims, damages, losses, and expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law or the rights of a third party; or (d) any contact data you export from the Service being used in violation of applicable law.

12. Termination

Either party may terminate this agreement at any time:

• You may cancel your account at any time from your account settings or by emailing sales@send-burg.com.
• We may terminate or suspend your account immediately and without notice if you violate these Terms, engage in fraudulent activity, or pose a legal or security risk.
• Upon termination, your right to use the Service ceases immediately. We will retain your account data for 90 days before deletion, during which you may request an export.
• Sections 8 (Intellectual Property), 9 (Disclaimer), 10 (Liability), 11 (Indemnification), and 13 (Governing Law) survive termination.

13. Governing Law

These Terms are governed by the laws of India. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka, India.

For customers located in the European Union, the above jurisdiction clause does not affect your statutory rights under EU consumer and data protection law.

14. Changes to Terms

We may update these Terms from time to time. We will notify registered users of material changes by email at least 14 days before the effective date. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Service and cancel your subscription before the effective date.
